Whether outdoors or indoors, waterslides are popular attractions for both children and adults. Unfortunately, steep drops, slick surfaces and the absence of protective equipment can lead to serious injuries if waterslide operators are not diligent about safety measures. A Bergen County personal injury claim alleges that a youth will never fully recover after a waterslide accident at the American Dream complex in East Rutherford.
According to the lawsuit, the incident occurred on April 19 of last year when the plaintiff brought his son to the DreamWorks Water Park within American Dream. During their visit, the boy was using a waterslide when he was allegedly injured due to what the suit describes as a “dangerous and unsafe condition” on the slide. The nature of the condition has not been specified in the filing, but the injuries are described as severe and permanent.
Amusement park operators have a legal duty to maintain safe conditions for their patrons. Under premises liability law, property owners and operators have a duty to inspect, repair and warn of any hazardous conditions that could pose a risk to visitors. Failure to meet these obligations can result in liability for injuries sustained on the premises. In this personal injury case, the plaintiff will need to demonstrate that the water park operators were aware of, or should have been aware of, the dangerous condition on the waterslide and failed to take appropriate action to address it.
Given the potential danger associated with waterslides, owners and managers of these attractions need to observe best practices at all times. This includes monitoring water pressure, conducting frequent inspections for damage to the slide and making sure that there is a proper interval between riders.
