As two- and three-wheeled electric bicycles (e-bikes) gain popularity in New Jersey, police departments and hospitals are noticing more injuries stemming from accidents involving these machines. In some cases, riders are hurt after being hit by a car truck. In other situations, e-bikes strike pedestrians or other vehicles.
E-bikes can travel faster and cover longer distances with less physical exertion than strictly human-powered bicycles, making them a preferred choice for some commuters, delivery workers and recreational riders. Their speed and flexibility can be very beneficial on congested New Jersey roads. These vehicles combine some elements of traditional bicycles, which do not have to be registered with the state, and motorcycles, for which registration and insurance are required. Currently, electric bicycles are not regulated in the same way as motorcycles, but that might be changing.
The New Jersey Legislature is now considering a measure that would mandate registration and minimum levels of accident insurance for Class 1 (extra power available when the rider is pedaling) and Class 2 (no pedaling required) electric bikes. While the proposed annual registration fee would only be $8, the insurance provision could be much more expensive given that the minimum coverage level would be $25,000 upon enactment and increase to $35,000 in 2026.
Sponsors of the bill argue that the increased speed and power of e-bikes justify a regulatory system similar to the one that applies to motorcycles. By holding e-bike riders to a higher standard of accountability, lawmakers hope to improve overall road safety.
Opponents, however, argue that the costs associated with registering and insuring an e-bike could discourage their use, particularly among low-income riders who rely on e-bikes for affordable transportation. Additionally, the process of registering and insuring e-bikes might create logistical hurdles that could further burden riders.
